Release Notes version 8.0

  • Chapter 1: Power now includes expanded primers on the Communications Act, Chevron and Loper Bright, and the First Amendment.
  • Chapter 2: Entry migrates and expands the “How” materials from the previous edition into a new Broadcast subsection on Spectrum Policy, restoring the historical Civil Rights materials from an earlier edition of the book.
  • Chapter 4: Indecent Content is migrated earlier in the book, noting the pedagogical appeal of introducing these materials earlier in the semester.
  • Chapter 5: Access and Chapter 6: Classification are reorganized from the previous edition:
    • Chapter 5: Access now focuses on access issues in pre-Internet industries (broadcast, telephony, and cable television), includes a fuller treatment of Southwestern Cable, and condenses the treatment of DBS from the previous edition.
    • Chapter 6: Classification now focuses on unpacking the full net neutrality saga in historical order through the lens of classification, consolidating the previous edition’s split treatment of various episodes in the saga and adding coverage of the 2024 item and new notes and questions on the role of Loper Bright
  • Chapter 7: Internet Platforms (retitled from Intermediary Liability) adds additional subchapter headings to ease the exploration of Section 230, new coverage of the NTIA’s Section 230 petition to the FCC, and a dedicated new capstone section on Moody v. NetChoice.
  • Chapter 8: Privacy adds new coverage of FCC and state roles in regulating privacy, including discussion of the Congressional Review Act and preemption.
